Moeyo Terms of Service

Article 1 (Purpose)

These Terms of Service (the "Terms") establish the rights, obligations, and responsibilities between Moeyo.ai (sole proprietorship, hereinafter referred to as the "Operator") and members in relation to the use of the biological observation recording and AI-based classification service (the "Service") provided by the Operator, and stipulate other necessary matters. The Service provides Members with an experience of easily recording organisms encountered in daily life, automatically organizing them through AI, and building their own personal collection.

Article 2 (Definitions)

The terms used in these Terms are defined as follows:

1. "Service" refers to all features provided by the Operator, including biological observation image upload, AI-based automatic species classification, record management, and collection organization.
2. "Member" refers to a person who agrees to these Terms and enters into a service use agreement with the Operator.
3. "Content" refers to image files and related metadata (capture time, GPS coordinates, species identification information, tags, etc.) uploaded by members to the Service.
4. "AI Classification" refers to the function of automatically classifying species of organisms in images through artificial intelligence models provided by the Operator.
5. "Clustering" refers to the function of automatically grouping uploaded images based on AI classification results, capture time, location, etc.

Article 3 (Publication and Amendment of Terms)

1. The Operator shall post the content of these Terms on the Service screen so that members can easily access them.
2. The Operator may amend these Terms within the scope that does not violate relevant laws and regulations when necessary.
3. When the Operator amends the Terms, it shall specify the application date and reason for amendment and post them on the Service screen along with the current Terms from 7 days before the application date until the day before the application date. However, for amendments unfavorable to members, notice shall be given from 30 days in advance and notification shall also be sent via email.
4. If a member does not agree to the amended Terms, they may request membership withdrawal, and if they continue to use the Service after the effective date of the amended Terms, they shall be deemed to have agreed to the changes.

Article 4 (Provision and Modification of Services)

1. The main services provided by the Operator are as follows:
   • Biological observation image upload and storage
   • AI-based automatic species classification
   • Image clustering and classification
   • Personal collection management (Lifebook)
   • Species information search and viewing
   • Push notifications (service and marketing notifications)
   • Content posting and social features (episodes, feeds, public profiles, etc.)
   • Other services developed by the Operator
2. The Operator may change the content of the Service for reasons such as changes in technical specifications, and in such case, shall post the changed Service content and provision date on the Service screen.
3. The Operator may modify, suspend, or change part or all of the free services according to the Operator's policies and operational needs, and shall not provide separate compensation to members for this unless there are special provisions in relevant laws.

Article 5 (Formation of Service Agreement)

1. A service use agreement is formed when a person who wishes to become a member (the "Applicant") agrees to the content of these Terms, applies for membership, and the Operator approves it.
2. The Operator provides simple registration through Google OAuth2 and Apple Sign-In, and applicants can register for the Service through their Google or Apple accounts.
3. The following consents are required upon membership registration:
   • These Terms of Service
   • Privacy Policy
   • Use of content for service improvement (such as enhancing AI classification accuracy)
   • Display and recommendation of content within the service
4. The Operator may not approve or may terminate the use agreement after the fact for applications that fall under any of the following:
   • Using another person's name
   • Providing false information
   • Applying for the purpose of disrupting social order or public morals
   • Intending to use the Service for improper purposes
   • Other cases where the requirements for application set by the Operator are not met
5. The Operator does not permit registration by persons under the age of 14 (or the minimum age required by applicable laws in the member's country of residence). If it is confirmed that a person below such age has registered, the Operator may immediately terminate the service agreement with such member.

Article 6 (Changes to Member Information)

1. Members can view and modify their personal information through the settings page within the Service.
2. Members must immediately modify online or notify the Operator of changes by email or other means when information provided during membership registration changes.
3. The Operator shall not be responsible for any disadvantages arising from members' failure to notify the Operator of changes.

Article 7 (Obligation to Protect Personal Information)

1. The Operator strives to protect members' personal information in accordance with relevant laws. The relevant laws and the Operator's Privacy Policy apply to the protection and use of personal information.
2. The Operator may use all content and metadata uploaded by members for service improvement and AI model training. This is a matter agreed upon during membership registration.
3. The Privacy Policy is published on the Service screen, and members can view it at any time.

Article 8 (Member Account Management)

1. Members are authenticated through Google OAuth2 or Apple Sign-In, and the responsibility for security management of that account lies with the member.
2. Members must immediately notify the Operator and follow the Operator's guidance if their account is used improperly.
3. The Operator shall not be responsible for any disadvantages arising from members' failure to provide notification under Paragraph 2 of this Article or failure to follow the Operator's guidance.

Article 9 (Notification to Members)

1. When the Operator notifies members, it may do so to the email address provided by the member during registration.
2. For notifications to an unspecified number of members, the Operator may substitute individual notification by posting on the Service screen.

Article 10 (Member Obligations and Prohibited Acts)

1. Members shall not engage in the following acts:
   • Registering false information when applying for or changing membership
   • Stealing other people's information
   • Altering information posted by the Operator
   • Transmitting or posting information other than that designated by the Operator (such as computer programs)
   • Infringing on intellectual property rights such as copyrights of the Operator or other third parties
   • Acts that damage the reputation of or interfere with the business of the Operator or other third parties
   • Acts of publicly disclosing or posting obscene or violent messages, images, sounds, or other information contrary to public order and morals on the Service
   • Uploading adult content, illegal content, or content containing hate speech
   • Intentionally uploading large amounts of images unrelated to the Service (abusing)
   • Acts that interfere with others' activities or cause harm to others without justifiable reason
   • Unauthorized mass uploading using automated means (bots, scripts, etc.) (until API is provided)
   • Other acts that violate relevant laws or are contrary to good customs or other social norms
2. Members must comply with these Terms and relevant laws and shall not engage in acts that interfere with the Operator's business.

Article 11 (Copyright and Use of Content)

1. Copyright of content uploaded by members belongs to the member.
2. Unless the member explicitly specifies a different license, All Rights Reserved applies to uploaded content. If the Operator provides a license selection feature in the future, members may choose their preferred license when uploading.
3. The Operator may use content uploaded by members for the following purposes:
   • AI model training and service improvement
   • AI Model Publication: Trained AI models or their derivatives may be released for research, education, open-source, or other purposes. The Operator takes reasonable technical measures to prevent extraction of individual Members' original data from published models.
   • Species classification recommendations, thumbnail generation, search indexing
   • Display on Service screen (including algorithm-based exposure)
   • Service promotion and marketing (with explicit member consent)
4. Uploaded images have obfuscated unique addresses (URLs), making it difficult for third parties to guess and access them unless directly shared by the member. The Operator does not provide functionality to browse all images of a specific user. However, content set to 'Public' by the member may appear in search results.
5. GPS information is private by default and is only displayed to other users when the member chooses to make it public in settings.
6. Members may report content that infringes their copyright to the Operator, and the Operator will take measures in accordance with relevant laws.
7. All legal liability arising from members infringing on others' copyrights lies with the member.

Article 12 (Restriction and Suspension of Service Use)

1. If a member violates the obligations under Article 10 or interferes with the normal operation of the Service, the Operator may take the following measures at the discretion of the management based on the severity and intent of the violation:
   • Minor violation: Warning and content deletion
   • Significant violation: Temporary suspension (3 to 30 days)
   • Serious violation: Immediate permanent suspension without warning and reporting to investigative authorities in accordance with applicable laws
     (e.g., CSAM (child sexual abuse material) and other illegal content, malicious abuse)
2. The Operator may set the conditions and details of restrictions within the scope of Paragraph 1 in the operation policy.
3. Members may appeal restrictions under this Article according to procedures set by the Operator, and if the appeal is deemed justified, the Operator will immediately resume service use.
4. The Operator may restrict or suspend all or part of the Service in the following cases:
   • Maintenance, regular inspection, or construction of service facilities
   • When telecommunications service providers defined in the Telecommunications Business Act have suspended telecommunications services
   • National emergency, service facility failure, or service usage overload
   • Other force majeure circumstances

Article 13 (Disclaimer)

1. The Operator is exempted from liability for providing the Service when it cannot provide the Service due to natural disasters or equivalent force majeure.
2. The Operator shall not be responsible for obstacles to service use due to members' fault.
3. AI Classification Accuracy: The AI-based species classification service provided by the Operator is for reference purposes only, and does not guarantee 100% accuracy. Members are responsible for manually reviewing and correcting AI classification results.
4. Data Loss: Although the Operator operates a backup system, data loss may occur in extreme situations including unexpected technical errors during the beta testing period, and the Operator shall not be liable for this unless there is gross negligence. We recommend backing up important records individually.
5. The Operator shall not be responsible for the reliability, accuracy, or other content of information, materials, and facts posted by members on the Service.
6. The Operator is exempted from liability in cases of transactions between members or between members and third parties through the Service.
7. The Operator shall not be liable in relation to the use of free services unless there are special provisions in relevant laws.
8. Infrastructure Changes: The Operator may change or migrate the infrastructure used to provide the Service (cloud storage, database servers, etc.) to other cloud providers according to operational circumstances, and will make efforts to minimize temporary service interruptions through prior notice.

Article 14 (Dispute Resolution)

1. The Operator shall establish and operate a complaint and damage handling channel to reflect legitimate opinions or complaints raised by members and to handle compensation for damages.
2. The Operator shall prioritize handling complaints and opinions submitted by members. However, if prompt handling is difficult, the Operator will immediately notify the member of the reason and processing schedule.
3. When there is a member's request for damage relief regarding service-related disputes between the Operator and members, the Operator may follow the mediation of dispute resolution organizations designated under applicable Korean law.

Article 15 (Jurisdiction and Governing Law)

1. The laws of the Republic of Korea shall apply to the interpretation of these Terms and disputes between the Operator and members.
2. Lawsuits arising from disputes between the Operator and members shall be filed with the competent court under applicable law.

Article 16 (Membership Withdrawal and Account Deletion)

1. Members may request withdrawal at any time through the service settings page or by email (support@moeyo.ai).
2. Upon withdrawal request, a 30-day grace period applies. During this period, the account will be deactivated and the member's content will not be exposed to other users.
3. If the member logs in again during the grace period, the withdrawal request will be automatically cancelled and the account will be restored.
4. After the grace period expires, the following data will be permanently deleted:
   • Profile information (name, email, profile photo, etc.)
   • Original uploaded images and metadata
   • Observation records, album bookmarks, tags, and other service usage data
5. AI Training Data: Data already used for AI model training is integrated into model weights and individual deletion is extremely difficult with current technology. This is a matter consented to at the time of membership registration.
6. Information required to be retained by relevant laws will be stored for the period prescribed by such laws and then destroyed.

Article 17 (Notification Services)

1. The Operator may send service notifications (upload completion, account-related notices, system announcements, etc.) via email or push notifications.
2. The Operator may send marketing notifications (events, promotions, new feature announcements, etc.) only with the Member's separate consent.
3. Members can configure notification preferences by category in the service settings page. Marketing notifications can be opted out of at any time.
4. Notifications essential to service operation (terms changes, security-related notices, etc.) are exempt from opt-out.

Article 18 (Content Posting and Social Features)

1. Members may create posts such as episodes, species guides, and breeding/cultivation diaries using their uploaded content.
2. Members may set the visibility of their posts to one of the following:
   • Public: Viewable by all service users
   • Friends only: Viewable only by friends designated by the Member (a publication period may also be set)
   • Private: Viewable only by the Member
3. Posts set to public may appear in other users' feeds, search results, and profile pages. The Operator may display such content within the service for promotional purposes.
4. Comments: Members may comment on other Members' published posts. Comments on public posts appear in a public thread visible to all users; comments on friends-only posts are visible only 1:1 between the post author and the comment author. When a post is made private or its publication period ends, its comments are hidden along with it. A comment may be deleted by its author or by the post author.
5. Asking for a name (question posts): Members may post questions asking other users for the name of an organism. By nature, question posts are always published publicly with no publication period. Members may make a question post private at any time. Other users may answer with comments and name suggestions, and may agree with (vote for) suggestions. No location information (coordinates or place names) is stored or displayed on question posts.
6. The Operator may set usage limits (such as posting limits) to keep the service stable and prevent abuse. Limits are communicated within the service.
7. Members may bookmark other Members' profiles to view their public posts in their feed. Bookmark counts and lists are not visible to other users.
8. The like count and details within the service are visible only to the Member themselves and are not disclosed to other users.
9. Members may edit or delete their own posts at any time.

Article 19 (Separate Consent for Image Use)

1. The Operator may use Members' images for quizzes, educational content, and similar purposes within the service, and will obtain separate consent from the Member for each applicable image.
2. Members' images will not be used as quiz material or educational resources without separate consent. This is distinct from the AI training and search consent provided under Article 5, Paragraph 3.
3. Members may withdraw their separate consent at any time, and the relevant images will be removed from the associated content upon withdrawal.

Article 20 (Community Safety and Content Moderation)

1. Reporting: Members may report posts and comments that appear to violate these Terms or applicable laws from within the service. The reporter's identity is not disclosed to the reported party, and the Operator may retain the content of the reported material as of the time of the report for handling purposes.
2. Operator's moderation authority: Based on reports, user requests, or its own review, the Operator may take the following actions against content suspected of violating these Terms, applicable laws, or the rights of others:
   • Hiding, unpublishing, limiting the exposure of, or deleting the content
   • Usage restrictions under Article 12 (warning, temporary suspension, permanent suspension)
   • Where the violation is clear or urgent, taking action without prior notice, followed by notification
   Members may object to such actions through the procedure in Article 12, Paragraph 3.
3. Self-management tools: Members may manage their own space without the Operator's involvement using the following tools:
   • Hiding a specific user's comments on their own posts (the hidden user is not notified)
   • Making their own posts private and deleting comments on their own posts
4. Takedown requests for protected species: A user who believes a public post risks revealing the location or existence of a protected species may send a takedown request. The request is delivered to the author anonymously, and even if the author takes no action, the Operator may review and make the post private.
5. Moderation is currently performed primarily through review by the operating team; automated means (such as AI) may assist or replace parts of this review in the future. Material changes will be announced within the service.
